The Accelerated Skilled Worker Procedure helps companies and skilled workers from third countries to shorten the entry process.
With the authorization of the skilled worker, the company can initiate such a procedure at the responsible foreigners’ authority for a fee of €411, provided there is a concrete job offer.
Throughout the procedure, the employer plays a central role. Although the foreign skilled worker remains the official applicant, the employer acts as the authorized representative during the process. This entails the following obligations:
The employer signs an agreement with the State Reception Authority of Lower Saxony (Landesaufnahmebehörde Niedersachsen) to initiate the procedure. This agreement outlines the steps of the procedure, the required supporting documents, deadlines, as wellas the roles and responsibilities of all involved parties.
As the authorized representative, the employer serves as the main point of contact for both the State Reception Authority and the foreign skilled worker. The employer submits all necessary documents to the authority, communicates additional document requests to the skilled worker, and ensures that outstanding documents are provided.
Upon signing the agreement, the employer pays the processing fee of €411. However, the foreign skilled worker remains the actual liable party for the fee. In this context, the employer acts as the authorized representative as well.
If a preliminary approval is issued by the State Reception Authority, the authorized employer forwards it to the foreign skilled worker.
If an employer is recruiting a larger number of skilled workers from third countries, framework agreements can also be signed with the State Reception Authority. However, for each individual case, a separate agreement remains necessary due to personal information such as age, country of origin, and qualifications.
