Requirements
To initiate an Accelerated Skilled Worker Procedure, the following conditions must be met:
- The skilled worker must be known by name.
- A concrete job or training offer must be available.
- The skilled worker intends to enter Germany for one of the following purposes:
- Education and training (§ 16a Residence Act)
- Participation in qualification measures for recognition of foreign vocational training (§ 16d Residence Act)
- Skilled workers (§§ 18a, 18b Residence Act)
- Highly qualified professionals (§ 18c para. 3 Residence Act)
- Researchers (§ 18d Residence Act)
- Employment as an executive, manager, or specialist (§ 19c para. 1 Residence Act in conjunction with § 3 Employment Regulation)
- Employment as a scientist or lecturer (§ 19c para. 1 Residence Act in conjunction with § 5 Employment Regulation)
- Temporary practical work related to recognition of foreign qualifications outside § 16d Residence Act (§ 19c para. 1 Residence Act in conjunction with § 8 para. 3 Employment Regulation)
- “Quasi-skilled” workers with extensive professional experience (§ 19c para. 2 Residence Act in conjunction with § 6 Employment Regulation)
- Employment in an individual case of public interest (§ 19c para. 3 Residence Act)
- Civil servants (§ 19c para. 4 sentence 1 Residence Act)
- The skilled worker must be residing in their country of origin or legally in a third country from which a visa is required.
- The employer must have power of attorney from the skilled worker.
- There must be no entry or residence bans.
- The skilled worker must have sufficient language skills, if applicable.
